TERMS AND CONDITIONS OF SALE

1. INTRODUCTION

Welcome to Fumbo Manufacture Limited. These Terms and Conditions govern all sales of school uniforms, sportswear, and related items (the "Products") by Fumbo Manufacture Limited ("we","us","our") to educational institutions ("Schools") and individual consumers ("Parents/Guardians," "you," "your"), whether online through our website (www.fumbo.co.ke), or via direct order to your school. By placing an order with Fumbo, you agree to be bound by these terms. Please read them carefully.

2. ACCEPTANCE OF ORDERS

  • All orders are subject to acceptance by us. We will confirm acceptance by issuing an Order Confirmation via email or SMS or in writing. A contract is formed only upon our issuance of this Order Confirmation.
  • We reserve the right to decline any order at our discretion, including for reasons of suspected fraud, typographical errors in pricing, or unavailability of stock.

3. PRICING AND PAYMENT

  • All prices are quoted in Kenyan Shillings (KES) and are inclusive of Value Added Tax (VAT) where applicable.
  • We reserve the right to adjust prices in the event of increases in material costs. Prices confirmed in an Order Confirmation are binding.
  • Payment methods
    • MPESA (Till Number 418713)
    • Bank Transfers
    • Or other methods as specified on our invoice.
  • For Schools: Payment terms are strictly Net 30 days from the date of invoice, unless otherwise agreed in writing. Late payments incur interest charges and suspension of further orders.
  • For Parents/Guardians: Full payment is required before order processing and dispatch.

4. CUSTOMIZATION AND PERSONALIZATION

  • Products involving customization (e.g., school logos, crests, student names) are considered Final Sale and cannot be returned, exchanged, or refunded unless they are faulty or the error is due to our fault.
  • The customer is solely responsible for approving all final artwork, design proofs, and placement details before production begins. We are not liable for errors resulting from customer-approved designs.

5. DELIVERY

  • Delivery Areas: We deliver nationwide within Kenya. Free delivery to the school. Delivery fee within the Nairobi Metropolitan is Ksh.200. Delivery charges vary based on location nationwide and will be calculated at checkout.
  • Delivery Timeline: Standard delivery takes 5-7 business days from order confirmation. Delivery times are estimates and are not guaranteed, as they are subject to carrier performance and factors beyond our control.
  • Risk and ownership: The risk of loss or damage to the products passes to you upon delivery. Ownership of the products passes to you once we have received full payment.
  • Delivery Inspection: It is the responsibility of the School or Parent/Guardian to inspect the Products upon delivery and notify us of any discrepancies or damage within 48 hours.

6. SPECIAL SERVICE PROGRAMS

Fumbo Manufacture Limited offers the following special programs to provide added value to our customers.

6.1 GROUP BUYS FOR PARENTS:

  • A "Group Buy" is defined as a single order for multiple children, consolidated by a parent representative ("Group Coordinator").
  • The Group Coordinator is responsible for collecting all orders, sizes, and payments from the group and submitting a single, consolidated order and payment to Fumbo Manufacture Limited.
  • Discounts: Group Buys may be eligible for volume-based discounts, as specified at the time of order. Discounts are applied to the final consolidated invoice only.
  • Delivery: We will deliver the entire consolidated order to a single address specified by the Group Coordinator. It is the Group Coordinator's responsibility to distribute the items to the respective parents. We are not responsible for distribution errors made by the Group Coordinator.
  • Returns/Exchanges: Any returns or exchanges for items from a Group Buy must be handled individually by each parent directly with us, in accordance with our standard Returns Policy (as per Clause 7).

6.2 REPLACEMENT OF OUTGROWN GARMENTS PROGRAM:

  • This program allows parents to exchange used Fumbo Manufacture garments that their children have outgrown for a larger size.
  • Eligibility: The returned garment must be a Fumbo original, in good, wearable condition with minor wear and tear, and must be clean.
  • Process and Credit: Upon our inspection and acceptance of the returned garment, we will issue a store credit equivalent to 20% of the garment's original selling price. This credit can be applied towards the purchase of a new, larger-size uniform or sportswear item.
  • This program is offered at our discretion and may be withdrawn or modified at any time. It does not apply to socks, tights, swimwear, or heavily damaged items.

6.3 BUNDLING SERVICES

  • We offer bundled packages for Schools and Parents, which may include a combination of uniforms, PE kits, and sportswear at a special package price.
  • The contents of each bundle are fixed as described at the time of purchase. Individual items cannot be removed from a bundle to adjust the price.
  • Returns for Bundles: If a bundle is returned in its entirety and meets the standard return conditions, the full bundle price will be refunded. If individual items from a bundle are returned, the refund will be calculated based on the individual item's pro-rated price, not its share of the bundled discount.

7. STANDARD RETURNS, EXCHANGES, AND REFUNDS POLICY

This policy is designed to be fair and reflects the nature of our products.

7.1 GENERAL CONDITIONS FOR ALL RETURNS/EXCHANGES:

  • The item must be unworn, unwashed, and in its original saleable condition, with all tags and packaging intact.
  • A valid proof of purchase (original receipt or order number) is mandatory.
  • Returns or exchanges must be initiated within 7 days of delivery for standard items.

7.2 FAULTY OR INCORRECT ITEMS (OUR ERROR):

  • If you receive a product with a manufacturing defect (e.g., faulty zipper, unraveling seams) or an incorrect item (wrong size/type), we will offer a full refund, replacement, or store credit.
  • We will cover the cost of return shipping for these items. Please contact our customer service team at fumbocoltd@gmail.com or +254 706 227267 to arrange a return.

7.3 CHANGE OF MIND OR INCORRECT SIZING (YOUR ERROR):

  • We offer exchanges or store credit for standard, non-customized items that are the wrong size, provided they meet the general conditions above.
  • Refunds for change of mind are not provided. All sales of non-faulty items are considered final once the order is fulfilled.
  • The customer is responsible for the cost of return shipping for the exchanges.

7.4 NON-RETURNABLE ITEMS:

For health and safety reasons, the following items are Final Sale and cannot be returned or exchanged unless faulty:
  • All Customized and Personalized Items (as per Clause 4)
  • Socks and Tights
  • Swimwear (if the hygiene seal is broken)
  • Clearance or specially discounted items
  • Items received through the Replacement and Outgrown Garments Program.

7.5 REFUND PROCESSING:

  • Approved refunds will be processed to the original payment method.
  • Please allow 7-14 business days for the refund to be reflected in your account.

8. WARRANTIES

All our products come with a warranty against manufacturing defects for a period of 90 days from the date of purchase. This warranty covers issues like faulty zippers, unraveling seams, or defective fabric. It does not cover damage resulting from normal wear and tear, improper washing, neglect or accidents.

9. DATA PROTECTION

We are committed to protecting your data. Our Privacy Policy, which outlines how we collect, use, and store your personal information, forms part of these Terms and Conditions. We comply with the Kenyan Data Protection Act.

10. LIMITATION OF LIABILITY

Our total liability to you for any claim arising from these Terms or the Products shall not exceed the total price of the Products purchased by you in the relevant order.

11. FORCE MAJEURE

We will not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, lockouts, or failures of public utilities or telecommunications networks.

12. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya.

13. AMENDMENTS

Fumbo Manufacture Limited reserves the right to amend these Terms and Conditions at any time. The terms in effect at the time of your order will apply to that order.
